Ottawa, 22 November 2013 –The Canadian Judicial Council announced today that a Panel of three judges will undertake further review of the conduct of the Honourable Michel Déziel.

Allegations surrounding the conduct of Justice Déziel were raised in the context of an ongoing Commission of Inquiry and were brought to the attention of Council in May 2013. In accordance with the Complaints Procedures of Council, these allegations were considered by the Honourable Edmond Blanchard, Vice-Chairperson of the Judicial Conduct Committee of Council. Having considered all the available information, including the judge’s response to the allegations, Chief Justice Blanchard has decided that this matter would benefit from further consideration by a Panel of three judges.

Referring a matter to a Review Panel is one of the options available to the Council as part of the early remedial stages of the complaint process. The Panel which is comprised of three judges (two Council members and one other judge) will now review the matter and will decide if the file should be closed or whether other measures should be taken.

Council takes the review of complaints about a judge’s conduct seriously and treats every complaint in accordance with its Complaints Procedures. Information about the Council and its work to foster public confidence in the judiciary can be found on the Council’s website at www.cjc-ccm.gc.ca.

Le Conseil canadien de la magistrature annonce les prochaines étapes dans l’examen de la conduite de l’honorable Michel Déziel

Ottawa, le 22 novembre 2013 –Le Conseil canadien de la magistrature a annoncé aujourd’hui qu’un comité de trois juges entreprendra un examen plus approfondi de la conduite de l’honorable Michel Déziel.

Des allégations concernant la conduite du juge Déziel ont été soulevées dans le cadre d’une Commission d’enquête et ont été portées à l’attention du Conseil en mai 2013. Conformément aux Procédures relatives aux plaintes du Conseil, les allégations ont été examinées par l’honorable Edmond Blanchard, Vice- Président du Comité sur la conduite des juges. Après avoir examiné les renseignements disponibles, y compris les commentaires du juge, le juge en chef Blanchard a décidé que cette question bénéficierait d’ un examen plus poussé.

Le renvoi d’un dossier à un comité d’examen est l’une des options qui s’offrent au Conseil dans le cadre des étapes préliminaires, informelles et correctives. Le comité, qui est composé de trois juges (deux membres du Conseil et un autre juge) va maintenant examiner la question et décidera si le dossier peut être fermé ou si d’autres mesures doivent être prises.

Le Conseil prend l’examen des plaintes concernant la conduite d’un juge au sérieux et traite toutes les plaintes conformément à ses Procédures relatives aux plaintes.
